Terms of Service

1. Acceptance of Terms
By accessing or using BloomHub ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.
BloomHub is a marketplace that connects independent plant growers ("Sellers") with buyers ("Buyers"). We provide the platform and payment processing infrastructure, but we are not a party to transactions between Sellers and Buyers.
2. Account Registration
To use certain features of the Platform, you must create an account. You agree to:
• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account
You must be at least 18 years old to create an account. Accounts are for individual use only and may not be shared or transferred.
3. Marketplace Rules
For Sellers:
• You must accurately describe products and use authentic images
• You are responsible for fulfilling orders as described
• You must comply with all applicable laws regarding plant sales
• You set your own prices and shipping policies
• You agree to pay applicable platform fees on completed sales
For Buyers:
• You agree to pay for items you purchase
• You must provide accurate shipping information
• You agree to review seller policies before purchasing
• You will communicate issues directly with sellers first
4. Payments and Fees
All payments are processed through Stripe. BloomHub collects a platform fee of 5% on completed sales, which includes payment processing costs.
Sellers receive payouts directly to their connected bank account through Stripe. Payout timing depends on Stripe's policies and the seller's account settings.
Refunds are handled according to individual seller policies. If a seller agrees to a refund, BloomHub's platform fee is also refunded.
5. Prohibited Items and Conduct
The following are prohibited on BloomHub:
• Invasive species or plants illegal in buyer's location
• Fraudulent or misleading listings
• Harassment, abuse, or threatening behavior
• Circumventing the platform to avoid fees
• Fake reviews or rating manipulation
• Any illegal activity
6. Intellectual Property
Sellers retain ownership of their product photos and descriptions. By posting content, sellers grant BloomHub a non-exclusive license to display that content on the Platform.
The BloomHub name, logo, and platform design are owned by BloomHub and may not be used without permission.
7. Disclaimers
BloomHub provides the Platform "as is" without warranties of any kind. We do not guarantee:
• The quality or accuracy of any listing
• That plants will survive shipping or thrive after planting
• Continuous, uninterrupted access to the Platform
BloomHub is not a party to transactions between Buyers and Sellers. We facilitate the marketplace but are not responsible for the actions or products of individual users.
8. Limitation of Liability
To the maximum extent permitted by law, BloomHub shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
Our total liability for any claim related to the Platform shall not exceed the fees paid to BloomHub in the 12 months preceding the claim.
9. Dispute Resolution
Disputes between Buyers and Sellers should first be resolved directly between the parties. If assistance is needed, contact info@bloomhub.us.
Any disputes with BloomHub will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.
10. Account Termination
We may suspend or terminate accounts that violate these Terms or our Community Guidelines. Users may also close their accounts at any time by contacting support.
Upon termination, sellers must fulfill any outstanding orders. Access to account data may be retained for legal and business purposes.
11. Changes to Terms
We may update these Terms from time to time. We will notify users of material changes via email or through the Platform. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
